Posiciones arancelarias del Sector Energético excluidas del Impuesto país

Mediante la Res. 671/2023 de la Secretaría de Energía publicada hoy en el Boletín oficial se establecen las posiciones arancelarias que quedarán excluidas del pago del IMPUESTO PAÍS vinculadas con las actividades del Sector energético.

Recién hoy se conoce un breve listado de posiciones arancelarias – principalmente orientadas a la actividad del Gasoducto Néstor Kirchner -, que quedarán excluidas de tributar el IMPUESTO PAÍS asociado con el acceso al Mercado Único y Libre de Cambios para el pago de importaciones.
¿Qué dice la Resolución?
Que quedarán excluidas de tributar el mencionado impuesto los siguientes casos vinculados con el sector energético:
a) las mercaderías comprendidas en las posiciones arancelarias de la Nomenclatura Común del Mercosur (N.C.M.) 2701.12.00, 2710.19.22, 2711.11.00, 2711.21.00 y 2716.00.00; y
b) las mercaderías destinadas a la construcción y puesta en marcha del GASODUCTO PRESIDENTE NÉSTOR KIRCHNER, para la reversión del Gasoducto Norte y conexas y a las obras integrantes del Programa Sistema de Gasoductos “Transport.Ar Producción Nacional”.
¿Cómo se deberá proceder para acceder al beneficio?
Para el caso de la mercadería comprendida en el punto b), quienes estén vinculados con la actividad deberán presentar ante la DIRECCIÓN GENERAL DE ADUANAS de la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS y al momento de acceder al MERCADO LIBRE DE CAMBIOS (MLC), ante la entidad autorizada por el BANCO CENTRAL DE LA REPÚBLICA ARGENTINA a operar en éste, una declaración jurada en los términos del formulario que se detalla como Anexo de la resolución en cuestión.
¿Qué más dice la Resolución?
Que la DIRECCIÓN GENERAL DE ADUANAS instrumentará, desde el punto de vista sistémico, las medidas pertinentes para garantizar la identificación y la trazabilidad de las mercaderías que resulten incluidas en los términos en el punto b.
¿Cuándo entra en vigencia?
Desde su publicación en el Boletín oficial. Pero probablemente tendremos que esperar un poco más para que en el Sistema Malvina se vean reflejados estos cambios.
